This policy is part of the Terms of Service of DP HOST (DP TECNOLOGIA LTDA, CNPJ 50.591.161/0001-75, its Brazilian company registration number). Its purpose is to protect the network and our customers, and to uphold the law. The Customer is responsible for the use of their VPS and for anyone who uses them.

1. The VPS may not be used for

  1. Illegal activities or activities that encourage crime, including fraud, scams and phishing.
  2. Illegal content: child pornography (reported to the authorities immediately), copyright infringement, piracy, sale of prohibited products or services.
  3. Attacks and network abuse: DDoS, port scanning, brute force, exploiting third-party vulnerabilities, botnets, open proxies, amplification.
  4. Sending spam, unsolicited mass mailing and hosting websites advertised through spam.
  5. Malware: creating, hosting or distributing viruses, ransomware, C2, stealers.
  6. Cryptocurrency mining — PROHIBITED on all plans, including cloud mining, mining pools, proof-of-work and cryptojacking, or any program that uses the VPS resources for that purpose. If DPHOST detects mining, the VPS will be suspended immediately, the agreement will be terminated, the VPS and its data will be deleted and the Customer's account will be BANNED from the company, without prior notice and without a refund (see section 5-A).
  7. Content that violates the rights of third parties: defamation, harassment, discrimination, violation of privacy or of Brazil's General Data Protection Law (LGPD).
  8. Reselling the resources of the VPS without written authorization from DPHOST.
  9. Abusive use of resources: sustained CPU, disk or network usage that harms other customers or the infrastructure.
  10. Circumventing limits, billing methods or security measures.

2. Game servers, VPNs and proxies

Game servers, VPNs and proxies are allowed as long as they do not violate this policy and do not cause network abuse. Game servers that are frequent targets of attacks may be suspended to protect the network.

3. Incoming attacks (DDoS)

The infrastructure has basic protection against network-layer (L3/L4) DDoS attacks. Application-layer (HTTP/HTTPS) attacks are not covered, and the Customer must use their own solutions (e.g., Cloudflare) for their websites. The network is subject to the mitigation limits of the infrastructure provider.

Port 25 (SMTP): blocked by default to prevent spam. The Customer may ask for it to be unblocked by ticket, stating the reason (for example, their own mail server). DPHOST reviews each request and may refuse it, or revoke the unblocking at any time, in the event of spam, abuse reports or risk to the reputation of the IP addresses. If a VPS comes under an attack that threatens the network, DPHOST may temporarily block the IP address (null route), and this does not constitute a breach of the SLA.

4. Abuse reports

Reports can be sent to contato@dphost.com.br. DPHOST investigates and may ask the Customer to resolve the problem within a short time (usually [24] to [48] hours).

5. Measures in case of violation

DPHOST may, at its discretion and depending on the severity:

  • notify the Customer and require correction;
  • suspend or limit the VPS, including without prior notice in serious or urgent cases;
  • terminate the agreement, without a refund;
  • cooperate with the authorities and provide data when required by law (Brazilian Internet Civil Rights Framework, Marco Civil da Internet — Law No. 12,965/2014);
  • charge the Customer for any losses and costs caused.

5-A. Cryptocurrency mining: zero tolerance

  1. DPHOST may detect mining by any reasonable technical means, such as known processes, connections to pools, a pattern of sustained and abnormal CPU usage, or alerts from the infrastructure provider.
  2. Once mining is detected: (a) the VPS is suspended immediately; (b) the agreement is terminated; (c) the VPS and the data on it are deleted; (d) the Customer's account and registration data (CPF/CNPJ Brazilian taxpayer numbers, email, payment methods) are banned and new orders will be refused; (e) there is no refund.
  3. If the VPS has been compromised and used by third parties for mining, the Customer is responsible, as they must keep their server secure (Terms of Service, clause 8). DPHOST will apply the same measures.
  4. DPHOST may charge the Customer for the losses caused (e.g., penalties from the provider, abnormal resource consumption).

6. Log retention

To comply with the law, DPHOST may retain access and connection logs related to the service for the period required by law, and provide them upon a court order.

7. Responsibility

The Customer is solely responsible for everything hosted on or done with their VPS. DPHOST does not monitor content, but may take action upon becoming aware of a violation.
